A US federal appeals court upheld a law that could result in TikTok being banned in the United States by next month, although the case is expected to go to the Supreme Court for further review. This ruling marks a significant victory for the Justice Department and critics of the Chinese-owned app, but is a major setback for TikTok’s parent company, ByteDance. TikTok currently has 170 million American users.

Appeals Court Rejects TikTok’s Petition
The appeals court rejected TikTok’s request to overturn the law, which mandates that TikTok sever its ties with ByteDance or face a ban by mid-January. The court dismissed TikTok’s argument that the law violated the First Amendment, which protects free speech in the United States. The court’s opinion, written by Judge Douglas Ginsburg, emphasized that the law is designed to safeguard American free speech from a foreign adversary and prevent data collection on US citizens by China.

Signed into law by President Joe Biden in April, the legislation marks the culmination of years of debate in Washington over TikTok’s potential national security risks due to its connections to China. Unless overturned by the Supreme Court, the decision places the fate of TikTok in the hands of President Biden, who will decide whether to extend the January 19 deadline for TikTok to sell or sever ties with ByteDance.

The court acknowledged its decision would lead to TikTok’s ban on January 19.

Trump’s Position on TikTok and Potential Ban
President-elect Donald Trump, who will take office on January 20, had previously sought to ban TikTok during his first term but now opposes the ban. He has pledged to “save” the platform. The appeals court stated that the law was the result of extensive bipartisan actions by Congress and successive presidents, aimed at addressing the national security threat posed by China through control of TikTok.

Impact of the Decision
The appeals court ruling sets the stage for TikTok’s ban on January 19 unless Biden grants an extension. The court noted that TikTok’s millions of users would need to seek alternative means of communication. The law was designed to counter China’s national security threat, which the court said involves using TikTok to gain access to vast amounts of personal data from Americans.

National Security and Free Speech Debate
The Justice Department argues that TikTok, under Chinese ownership, represents a serious national security risk due to its potential for covert information manipulation. TikTok and ByteDance, on the other hand, contend that the law is unconstitutional and infringes on Americans’ free speech rights, calling it a radical departure from the US’s commitment to an open internet.
