In response to a looming deadline, TikTok has filed an emergency motion seeking a temporary injunction to block a US law that mandates its parent company, ByteDance, to sell TikTok by January 19 or face a nationwide ban. The law, driven by national security concerns, threatens TikTok’s operations in the US just days before Donald Trump assumes office.

Challenging the Law in the Supreme Court
TikTok intends to challenge the law on constitutional grounds, arguing it violates the First Amendment. The company has urged the court to delay enforcement of the law to allow the Supreme Court time to assess its constitutionality. TikTok also pointed out that Trump could reverse the ban, as he suggested during his campaign, which would render the case moot.

Potential Financial Impact of a Ban
In its filing, TikTok highlighted the severe consequences of a ban, stressing that its 170 million American users, including small businesses and content creators, would be directly affected. Estimates suggest that a one-month ban could lead to over $1 billion in losses for small businesses, $300 million in lost earnings for creators, and a 29% drop in TikTok’s advertising revenue.

Request for Temporary Relief to Prevent Harm
TikTok argued that granting a temporary injunction would protect its users and businesses from significant harm without posing an immediate threat to national security. The platform noted that the government had already delayed enforcement by setting a 270-day deadline. TikTok further emphasized that a swift decision on the injunction would be crucial to allow the Supreme Court to consider the case during the holidays.

Government Pushback on Constitutional Claims
The US Justice Department has opposed TikTok’s request, arguing that the constitutional claims have already been rejected and that the court should swiftly deny the injunction. The department asserts that this would maximize the time for the Supreme Court to review the case.

Urgency for a Decision by December 16
TikTok has requested a decision on the injunction by December 16, with the government agreeing to respond by Wednesday. Should the injunction be denied, TikTok plans to seek emergency relief directly from the Supreme Court.

Global Implications of a US Ban
The potential ban not only threatens TikTok’s survival in the US but also poses risks to its global user base. TikTok warned that a US ban could disrupt service for millions of users worldwide, and there is no guarantee they would return if the ban were overturned.

The Role of the New Administration in TikTok’s Fate
If granted, the injunction would provide temporary relief to TikTok, but its long-term survival may depend on whether Trump decides to halt enforcement of the law. TikTok cautioned that resolving the issue through the courts only to have the new administration reverse the decision would be counterproductive. The company urged the court to act swiftly to avoid further complications.
