India’s Defense Ministry has empowered its military with the authority to issue direct takedown notices for unauthorized content related to the armed forces on social media. This shift enables the military to take quicker action on digital content that may impact national security or the military’s public image.

New Role for Strategic Communication Directorate

The ministry has designated the Additional Directorate General of Strategic Communication as the primary officer for these matters, allowing direct communication with social media platforms under Section 79(3)(b) of the IT Act. Previously, the military depended on the Ministry of Electronics and IT to initiate content takedowns, but this new authority simplifies and expedites the process.

Aiming to Counter Misinformation

According to sources, this move is intended to speed up response times to misinformation affecting national security. While no takedown notices have been issued since the order on October 24, officials expect this streamlined process to make managing digital misinformation more effective.

Legal Debate Over Section 79(3)(b) Powers

Section 79(3)(b) of the IT Act grants broad takedown powers across various government departments, sparking debate among legal experts over its scope. They point out that this section imposes fewer restrictions, raising concerns about the reach of government authority over digital content.

Recent Precedents in Content Control

In February, India’s Ministry of Information and Broadcasting ordered the takedown of an article by The Caravan concerning allegations against the Indian military. This action highlights the government’s ongoing efforts to regulate content related to national security and the military across digital platforms.
